Judge throws Toben extradition case out of court

District Judge Daphne Wickham ruled the warrant invalid today at the City of Westminster Magistrates’ Court in London, saying it contained inadequate detail about the offences.  It neither states the name of the website nor where the propaganda is said to have been published from - only referring to the ‘world-wide internet’.

After discharging Toben, Judge Wickham granted him bail pending an appeal after imposing strict conditions which include a £100,000 security.  Other conditions include residence at an approved address, written confirmation from the Australian High Commission of which passports he holds, and not to access the internet.  He is also banned from giving press interviews.

Judge Wickham added that she had not been required to decide at this stage whether the alleged crimes were valid extradition offences.

Grey wavy-haired Toben, smartly dressed in a suit, appeared pleased on hearing the judge’s decision from the glass-fronted dock at City of Westminster Magistrates’ Court.  The public gallery was packed with supporters of Toben.

So Dr Toben has been returned to his cell, pending his meeting the bail conditions and appeal by the German authorities.  Round one in this particular fight against the globalisation of Jewish justice is in the bag.

But the appellant will certainly now review the grounds for dismissal and the prospects for modifying their warrant.  It is interesting that, initially at least, they were so shy about making too much of the Adelaide Institute.  They are attempting to create a very wide legal precedent, whereby it’s not just that the accused can be extradited for an offense committed in Britain which exists only under German law, but he or she - we should never forget the splendid Sylvia Stolz - can be extradited by the British courts for an offence committed anywhere which exists only in German law.

If my memory serves me right, this might have been much more straightforward for the German authorities had the Lisbon Treaty not been sidelined by the Irish “No” vote, and had the British government not secured an opt-out - I think - from the extradition provisions in the Treaty.  In that sense, then, the Germans really are trying their luck.  I suspect they know they are not going to win, and they will not appeal.  Unless, of course, there is so much malice, they will do it anyway just to punish Toben.

But the final outcome should be clear to them.  Without the defining elements of the Lisbon Treaty in place, and since the British courts do not promiscuously extradite people just anywhere for an offence which does not exist under British statute, an appeal must fail.  Otherwise, it would open up the chaotic possibility that states with legal codes completely different to ours - Sharia, for instance - could similarly try their luck. That’s a direction the court could never take.

And all this before any consideration of the court’s duty to uphold freedom of expression!


88 ... 14 ... Obama - UPDATE: The culprit was the ADL

Law enforcement arrested two men in Tennessee who had plans to rob a gun dealer to shoot Democratic presidential candidate Barack Obama and “as many non-Caucasians” as possible, an official said on Monday.

An official from the Bureau of Alcohol, Tobacco, Firearms and Explosives said police found the men in the Jackson, Tennessee area with a number of guns, including a sawed-off shotgun, in their car.

“They wanted to go to a place where they could shoot as many non-Caucasian as they could,” the official said, noting that the men first planned to rob a gun dealer. “They also had a plot to assassinate Sen. Obama.”

The Associated Press gets the numbers sorted out.  88 for neo-nazis.  14 for the future of white children.

And, always important, the words: skinhead ... white supremacist ...

In court records unsealed Monday in U.S. District Court in Jackson, Tenn., federal agents said they disrupted plans to rob a gun store and target a predominantly African-American high school in a murder spree that was to begin in Tennessee. Agents said the skinheads did not identify the school by name.

Jim Cavanaugh, special agent in charge of ATF’s Nashville field office, said the two men planned to kill 88 black people, including 14 by beheading.

... The men also sought to go on a national killing spree after the Tennessee murders, with Obama as its final target.

... The men, Daniel Cowart, 20, of Bells, Tenn., and Paul Schlesselman 18, of Helena-West Helena, Ark., are being held without bond. Agents seized a rifle, a sawed-off shotgun and three pistols from the men when they were arrested. Authorities alleged the two men were preparing to break into a gun shop to steal more.

... For the Obama plot, the legal documents show, Cowart and Schlesselman “planned to drive their vehicle as fast as they could toward Obama shooting at him from the windows.”

“Both individuals stated they would dress in all white tuxedos and wear top hats during the assassination attempt,” the court complaint states. “Both individuals further stated they knew they would and were willing to die during this attempt.”

Something I don’t think the assassination scare in August achieved - this one makes the lead story on both news services.  Drip, drip.

Barack Obama plotters revealed to be small-town outcasts who met on internet

Two white supremacists charged with plotting to kill Barack Obama have been revealed to be a pair of emotionally troubled young outcasts who found each other through the internet.

Daniel Coward, 20, of Bells, Tennessee, and Paul Schlesselman, 18, of Helena-West Helena, Arkansas, hatched a bizarre but disturbing plan to go on a racist “killing spree” with the Democratic presidential contender as its ultimate target, say prosecutors.

The pair wanted to kill “88 people and behead 14 African-Americans” before shooting Mr Obama from their car in a suicide mission while wearing white dinner jackets and top hats, according to court papers.

The pair were arrested on Friday in Tennessee for illegal possession of firearms, threats against a presidential candidate and conspiring to rob a gun store.

In the pair’s home towns,

local people painted them as odd, and even disturbed, individuals.

In Helena-West Helena, Schlesselman was described as a “troubled child” by Marty Riddell, a colleague of his adoptive father, Mark Schlesselman.

Miss Riddell said she once tried to offer Schlesselman a pet lizard but was warned by his family that “he would hurt it”.

In Bells, a conservative Bible Belt town in a traditional southern cotton growing region, local people said Cowart had been an attention-seeker at high school, once starting a bomb scare.

Although neighbours were shocked to hear of his involvement, several - including a man who worked for the sheriff’s department - said there were more skinheads in the area than local people realised.

Guns and religion are strong in Bells and most men are keen hunters, although Cowart had apparently not been one of them.

He was more likely to have been found in church, said neighbours who said Cowart had once done missionary work for one of them.

Dudley Johnson, a car technician who lives near the large white colonial-style house where Cowart lived with his grandparents, described Cowart as a “nice little fella who used to work at the grocery store”. He added: “I think this was a cry for attention.”

Mr Johnson admitted his own father had tried to raise him to be a racist but that insisted “racism is not a big problem here - we try hard to get along with black people”.

Al Overton, a local hunter dressed in their uniform of camouflage jacket and baseball cap, said his initial shock at news of the plot had given way to a realisation that “This is 2008”.

He had little time for the Illinois senator. “Omama - Obama - thinks he’ll take the guns away but the hunters are not going to let him do that,” he said.

Investigators have admitted there did not appear to be any formal assassination plan. A lawyer for Cowart said he was reviewing the charges against his client “as well as the facts and circumstances of his arrest”.

It also emerged that the Anti-Defamation League, a Jewish civil rights organisation, helped lead federal investigators and local police to the pair.

The ADL, which monitors white supremacist groups, discovered that Cowart was involved in the Supreme White Alliance, a racist skinhead group.

Mr Obama told the Pittsburgh television station KDKA he was unconcerned about his safety given his protection from “the best folks in the world - the Secret Service”.

He added: “You know, look, I think what’s been striking about this campaign is the degree to which these kind of hate groups have been marginalised.”


Biden’s warning of a nation-shaking event in the future

A mystery has revealed itself before our eyes.  It lies in the concluding portion of US Senator Joe Biden’s speech at a Seattle fund-raiser.  His unsettling prediction is that a test of the next president will be “manufactured“ early in his incumbency.  But, most oddly, it will require ordinary Democrat voters and Obama supporters to show solidarity with their man and use their “influence within the community”.

What kind of test can Biden mean?

Here is the text taken from Alexander Cockburn’s piece on CounterPunch posted this weekend.

“Mark my words,” Biden said solemnly at a Seattle fundraiser last Sunday. “It will not be six months before the world tests Barack Obama like they did John Kennedy. The world is looking. We’re about to elect a brilliant 47-year-old senator president of the United States of America. Remember I said it standing here if you don’t remember anything else I said. Watch, we’re gonna have an international crisis, a generated crisis, to test the mettle of this guy.”

“I can give you at least four or five scenarios from where it might originate,” Biden went on. He mentioned the Middle East and Russia. “And he’s gonna need help. And the kind of help he’s gonna need is, he’s gonna need you - not financially to help him - we’re gonna need you to use your influence, your influence within the community, to stand with him. Because it’s not gonna be apparent initially, it’s not gonna be apparent that we’re right.”

What exactly is Biden hinting at in that last sentence? From the context of that whole paragraph it’s clear enough to me he’s suggesting that despite hopes nourished by the sort of people at that Seattle fundraiser that post-Bush/Cheney America might backpeddle from hasty military confrontations, President Obama will stand tall and lose no time in going eyeball to eyeball with those who would test his resolve.

So let’s try to answer Cockburn’s question.  These are the key elements Biden provides.

1. “President Obama” is going to be tested early, as Kennedy was tested in Cuba in 1962.  Possibly by Russia.  Possibly in the Middle-East.

2. He will respond militarily, not diplomatically.  This response will appear flat-wrong to many Americans.  National unity itself will be at risk.  The same kind of belief and support that elected Obama to office will be required to keep him there.

My colleagues and I have considered all kinds of situations in which a new president might need local community leaders to follow him blindly in some new foreign adventure.  The only one we can see that would be nation-shaking … the only one that would fit in the model of a black president and a dangerous military entanglement abroad, and which would give rise to the circumstance where lots of local support had to be brought behind him, would be the re-introduction of the draft.

Young white Americans may not be willing to risk their lives for a black Commander-in-Chief.  For sure, it is hard to believe that present-day American college students are any more eager to be cut up, shot, and killed in 2009 than they were in Johnson’s Vietnam. 

The image this calls to mind is the draft-dodging of the Vietnam era.  But Canada has already signalled its willingness to reject young diverse white Americans fleeing from a draft (along with other young Americans).  So the easy escape is blocked:-

… there’s a catch for those who flee to Canada. In the era of the Vietnam war, American draft dodgers and deserters could easily take up residence in Canada, and stay as long as they liked.  Now, however, Canadian law has changed.

“Well, legally what’s changed is that there’s a general policy in Canada now that to apply here you must apply from outside the country. And that’s not really an option that American troops could do,” said Jeffrey House, a Vietnam veteran who fled to Canada. “Because they’re gonna be sent to Iraq next week or next month.”

I don’t expect we’ll see the rebellious young with flowers in their hair this time.  And their natural recourse won’t be the ideals of the radical left and won’t be black civil rights, because these are the values of the political Establishment today.

But have you got any other ideas of substantive policy initiatives that couldn’t be implemented with only the powers in the presidency and the Congress … initiatives that would require wide-ranging local public support?

Ian Jobling put up a post two days ago at The Inverted World attacking Kevin MacDonald once again.  I thought it was about time someone put a friendly hand on Ian’s shoulder and asked him what the hell he thinks he’s up to, so I visited the thread and posted the comment below.  Because of the likelihood that it will never make the page, like one or two others on the JQ I’ve offered, I am posting it here.

Ian,

What, exactly, do you think you achieve by attacking MacDonald and boosting this crude hatchet job by Lieberman?  I, along with an awful lot of others, do not understand you.  We want to.  We try.  Some of us wonder whether you have a Jewish wife and Jewish children.  Otherwise, you simply do not make sense.

Your “message” requires that the many Jewish socio-political products that are so singularly damaging to the organic life of European peoples have absolutely no ethnic dimension.  It’s all just a big accident, and nothing to do with what Nathan Abrams described in his famed JC porno article as “the tradition of subversion”.  Not only are we supposed to believe that the said socio-political products, for example:-

Revolutionary internationalism
Critical Theory
Postmodernism
Freudianism
Second-wave Feminism
Second-Wave Libertarianism
Gay Rights/LBGT Rights
American Civil Rights
Human Rights
White Privilege/White Abolitionism

Encouragement for white race-mixing
Exploitation of the official holocaust narrative

Negative imagery of whites on film and TV
Anti-white bias in media reporting

... have no genesis in Jewish ethnic interests, but Jews have no group interests at all beyond the interests of all humanity!  Is that it, Ian?  Is that all you have been able to construe from the last century or so of European-Jewry relations?

Not good enough.  Jewish competitive ethnocentrism has to be identified or it cannot be restrained.  For, it does not moderate itself in the absence of external restraint.  In fact, the blood libel that is the exploitation of the holocaust, together with the promiscuous usage of the “anti-semite” trope, exists in large measure precisely to vitiate restraint, and to grant Jewish ethnocentrism free rein.

If you can’t acknowledge that, you are right back on Square One, chained to the spot. You are not a free-thinking man at all.  You are what Richard Dawkins described as an “extended phenotype”.  You have allowed yourself to become a vehicle for weakening and confusing the work of saving our people from dispossession and decline.  (Lieberman, by the way, denies any such exigency.)

Now, Ian, before you rush to apply to me the usual semitic soubriquet, it happens that I don’t hold the view that there is a Single Jewish Cause for our people’s woes.  I’m the goddamned moderate that you claim to be.  But I’m no Jewish extended phenotype.  It’s plain to me that we cannot free our people from their suicidal torpor if we give in to fear on this Question and tell them lies.  We cannot lie one minute to those we claim to love the next.  That isn’t how it works.

Make up your mind who and what you are, Ian.  You are needed.  You are talented.  Go to your duty.  Jewish ethnocentrism will get on fine without you.

Bill White as Extended Phenotype

There is hardly a more self-destructive target for white nationalists than a jury foreman.

Jury nullification is one of the most potent tools in the patriot’s toolbox—hence it is high on the target list of our enemies.

When Bill White goes after a jury foreman, he is creating a situation in which going after jurors who stand with white nationalists is simply “tit for tat”.  After all, if “white nationalists” don’t respect the foundation of common law citizen sovereignty—the jury—then they don’t deserve the protection of the jury via jury nullification, right?

It is infuriating when the SPLC is able to pack a jury—particularly selecting its foreman.  But the target should never be a juror—not even a juror who is an SPLC agent.


Obama in Philly

The Philadelphia Daily News, a struggling tabloid owned by the Catholic, former Bush publicist Brian Tierney, has managed to inform its - as Bo and Stanley would say - diverse white American readership that they or their cousins are “crackers”.  Here’s the offending extract from John Baer’s column on Tuesday:-

I think McCain’s camp is banking on Pennsylvania’s “cracker factor.”

I think the campaign believes the Democratic view - expressed by Ed Rendell last winter and Jack Murtha last week (and James Carville 22 years ago) - that there are racist tendencies among Pennsylvania voters.

Think about it.

Rendell in February said, “There are some whites who are probably not ready to vote for an African-American candidate.”

He even put a point spread on it, saying that being black in Pennsylvania costs a candidate 5 percentage points.

Murtha, a veteran Johnstown congressman, last week said, “There’s no question that western Pennsylvania is a racist area.”

He put the black penalty at 4 percentage points.

These guys are among the state’s most successful, longest- serving politicians: Rendell has been in office 22 years and is a former national party chairman; Murtha has been in Congress 34 years.

(Carville in 1986 famously said everything between Philly and Pittsburgh is “Alabama without black people,” which today insults Alabama; it has four times more black elected officials than Pennsylvania, according to U.S. Census data.)

So, if you take the most recent polling - an Allentown Morning Call poll Sunday is reflective of others and puts Obama 12 points up, 52-40 - I figure McCain’s folks figure, well, heck, that’s really only 7 points and since most polls have a 3-point margin of error, maybe just 4 points, and that puts us right in the game.

Meanwhile, McCain’s campaign, in TV ads and on the stump, is calling Obama’s tax- cut proposal a “government handout” and “welfare.” McCain yesterday said it’s “just another government giveaway.”

Whom do you think that’s aimed at?

Oh, I don’t know, maybe lower-income, less-educated white voters for whom “welfare” and “government giveaway” means black people?
